Short answer

Is retatrutide legal? The short answer for 2026

Retatrutide is not approved in any country.

As of 14 October 2026, no regulator has approved it. Lilly says it plans to submit retatrutide for U.S. approval in Q1 2027.[1] Until then, five things hold in the United States:

  • No compounding. FDA says retatrutide cannot be compounded under sections 503A or 503B.[2]
  • “Research use only” is not a shield. When a seller markets it for people, FDA treats it as an unapproved new drug, whatever the label says.[3]
  • Lilly is suing. It filed 11 suits against sellers, clinics and a pharmacy in 2026.[4]
  • DOJ and customs are involved. There are two criminal cases, two civil forfeitures and a customs operation of about 5,000 seized shipments.
  • The classification fight is open. Whether retatrutide is a drug or a biologic is on appeal.

Outside the U.S., the rules differ by country. Regulators in the UK, Australia, Canada, Switzerland and the Philippines have all acted against retatrutide products.

Three legal theories, one per kind of seller

Compounding fails 503A/503B

Used against telehealth sellers in September 2025. Retatrutide has no USP monograph, is not part of an approved drug and is on neither bulks list.[9]

“Research use only” is an unapproved new drug

Used against peptide sellers in 2024 and 2026. FDA looks past the label to the website, and if the evidence shows human use, the product is a drug.[3]

API distribution and repackaging

Darmerica sold retatrutide API to 503A compounders.[11] GenoGenix, a 503B facility, repackaged it.[13]

Code names do not help

Sellers listed it as “GLP-3 RT”, “GLP-3-R”, “GLP-1-R” or “Reta”. FDA named retatrutide anyway. One letter cites a dosing “cheat sheet” going up to 12 mg weekly.[24]

Despite statements on your product labeling marketing your products for “Research Use Only,” ... evidence obtained from your website establishes that your products are intended to be drugs for human use.

Each recipient name links to the letter on fda.gov. RUO = sold as “research use only”.

FDA's own summary page lists the same targets: telehealth firms, API distributors, outsourcing facilities and sellers of products falsely labelled “for research purposes.”[2] Import Alert 66-80, last revised 9 October 2026, lets customs detain GLP-1 bulk ingredients from firms not on FDA's green list. It does not name retatrutide; its “Peptide N.E.C.” codes may cover it, but that is our reading.[25]

What happened after the letters?

We found no public FDA injunction or seizure against any of the 22 recipients. A warning letter is a warning, not a court order. Note that TXP Innovations dba “Tex Peptides” (letter 22) is a different company from “Texas Peptides Inc.”, which Lilly is suing.

Private litigation

Lilly's retatrutide lawsuits against sellers

Lilly sued 11 sellers in two waves.

Six suits were filed on 12 August 2026 with a press release.[4] Five more followed on 8 October, with no release.[23] An earlier tirzepatide case, Pivotal Peptides, settled in 2025 with a promise not to sell retatrutide.[8]

Retatrutide cannot legally be sold for human use to anyone, anywhere, for any reason.

Two theories, and no trademark claims

None of the complaints pleads trademark infringement.

  • Three clinics and med spas face Lanham Act section 43(a)(1)(B) false-advertising claims.
  • Seven RUO sellers and one pharmacy face eight unfair-competition counts each: statutes in Alaska, Colorado, Connecticut, North Carolina, South Carolina, Tennessee and Washington, plus Texas common law. The underlying violations are state food-and-drug laws.[26]

Lilly asks for injunctions against selling anything “containing or purporting to contain retatrutide”, plus damages, disgorgement and fees.

What defendants say back

Legendary Peptides moved to dismiss on 2 October. It argues Lilly lacks standing, that its theory rests on Reddit posts, and that Texas allows no common-law claim built on the state drug act.[27]

Lilly seeks damages for lost sales due to a product it does not and cannot lawfully sell.

Legendary Peptides, motion to dismissE.D. Tex. · Oct 2, 2026

Striker Pharmacy has previewed a different defense. It says FDCA section 337(a) leaves enforcement to the federal government, calls disgorgement a windfall, and wants to depose FDA officials about Lilly's own pre-approval access program. Dispositive motions there are not due until 10 August 2027.[28]

A court mix-up in Lilly's release

Lilly's 12 August release places the Aesthetic Envy case in the Northern District of California. The docket is in the Eastern District, number 2:26-at-01347. An “at” number means no judge had been assigned at filing.[29]

What is being sold on the black market is not a medicine

David Hyman, chief medical officer, Eli LillyLilly press release · Aug 12, 2026

Lilly v. Kennedy

Is retatrutide a drug or a biologic?

The fight turns on one amino acid.

A “protein”, and so a biologic, needs more than 40 alpha amino acids. Retatrutide has 39 alpha amino acids in its backbone plus a side chain. FDA counted at most 40 alpha amino acids plus one non-alpha, and on 18 March 2024 called it a drug.[5] Lilly counts 41 in total.

The district court split the difference

Judge Tanya Walton Pratt ruled for FDA on the protein question. She ruled for Lilly on whether retatrutide is an “analogous product” and sent that issue back to FDA.[5][12]

the regulation unambiguously requires that proteins contain at least forty-one alpha amino acids.

U.S. District Court, S.D. IndianaAmended order · Oct 3, 2025

FDA's “bright line” approach flouts the statutory text and sidesteps congressional intent.

U.S. District Court, S.D. IndianaAmended order · Oct 3, 2025

The appeal is argued but undecided

Lilly appealed anyway.[30] It argues that FDA's 60-day deadline had passed, so the court should have made Lilly's classification final instead of remanding. The government says only alpha amino acids count and that the remand cannot be appealed.[31]

A panel of Chief Judge Brennan and Judges Easterbrook and Kirsch heard argument on 24 September 2026. It ordered extra memoranda on whether it has jurisdiction at all.[21] Both sides filed them on 8 October. There was no ruling as of 13 October.[30]

The government's brief concedes that biologics get “substantially longer exclusivity.”[31] The trade group for 503B outsourcing facilities filed in support of FDA.[32]

If retatrutide is a biologic, Lilly will receive an enormous windfall at the expense of patients.

Eli Lilly and Company, reply brief7th Cir. · Jun 5, 2026

In that June brief, Lilly said almost six months had passed with no new FDA decision on remand.[33] We found none since. Meanwhile Lilly's July release says it will file a Biologics License Application.[1] How a BLA proceeds while FDA's drug designation stands is not explained in any document we found.

Criminal, customs and international

Retatrutide cases beyond FDA letters

Retatrutide enforcement now includes criminal charges.

U.S. v. Taylor (M.D. Fla.)

AKT Labs sold “Retatrutide 5mg” as a “research chemical.” Its operator was charged in February 2026; a guilty-plea hearing entry is dated 26 August.[14] Counts and sentencing are not confirmed.

U.S. v. Watkins (D. Utah)

A Utah osteopathic physician faces 8 counts for receiving misbranded peptides, including retatrutide, from China and selling them to more than 200 patients. Trial is set for 18 December 2026.[16]

W.D. Missouri forfeitures

Two civil forfeiture complaints filed in June 2026 target property tied to Blome Research, an online seller of retatrutide, semaglutide and tirzepatide.[34]

CBP Cincinnati

Between December 2025 and March 2026, officers seized about 5,000 mis-manifested peptide shipments from China.[15]

On 18 September 2026, a 20-state attorney general coalition wrote to the Secretary of State about Chinese GLP-1 ingredients, naming retatrutide.[35] We found no state lawsuit specific to retatrutide.

Outside the United States

  • UK. The MHRA has raided three sites: Northampton (October 2025, over 2,000 pens),[10] Lincolnshire and Nottinghamshire (February 2026, about 2,000 doses)[36] and Northamptonshire (May 2026, about 12,000 doses, two arrests).[18]
  • Australia. The TGA and NSW Police seized more than A$120,000 of peptides, including retatrutide, in August 2026.[37] In September the TGA tested a “retatrutide” vial linked to a torn oesophagus.[20]
  • Canada. Health Canada's April 2026 advisory lists retatrutide among unauthorized peptides.[17] Lilly Canada issued its own safety notice in August.[38]
  • Switzerland. Swissmedic warned in August 2025 about a black-market “retatrutide injection kit.”[39]
  • Philippines. FDA Philippines warned against unregistered 30 mg retatrutide on 6 October 2026.[22]

the product contained undeclared semaglutide and no retatrutide.

Therapeutic Goods Administration (Australia)Safety alert · Sep 14, 2026

We found no EMA or German BfArM warning. For athletes, retatrutide is not named on WADA's 2026 Prohibited List. Section S0 bans any substance without government approval for human use, “e.g. drugs under pre-clinical or clinical development.”[40] Whether that catches retatrutide is an open question WADA has not answered.

Practical reading

What the retatrutide legal record means for buyers

The targets so far are sellers, not buyers.

The pattern is consistent. FDA letters and Lilly suits go after sellers that market for human use: they give dosing, make treatment claims, or run clinics and telehealth services. For the research-use-only sellers among the 22 letter recipients, the label did not help.[2][3]

The second risk is authenticity. The TGA's vial held semaglutide at about 8 times the approved strength and no retatrutide.[20] CBS reports two deaths submitted to FDA's adverse event database involving products sold as retatrutide. Those are FOIA'd reports that FDA has not verified.[41]

People comparing vendor prices and certificates for retatrutide for sale should keep both points in mind. A low price or a clean certificate does not change the legal status above. Our COA and lab testing analysis shows how often vendor certificates and independent tests disagree.

Outside trials, the only sanctioned access is Lilly's expanded-access program. It is limited to people with a BMI of 35 or more, two or more serious complications, no response to approved therapy and no trial option.[42] For what clinicians think of the drug itself, see our retatrutide expert opinions roundup.

Open questions and method

What is still unknown about retatrutide's legal status

Several big questions remain unresolved.

  • Will the 7th Circuit rule on the merits, or dismiss for lack of appellate jurisdiction?
  • Has FDA issued a new “analogous product” decision on remand? We found none.
  • How will Lilly file a BLA while the drug designation stands, and has FDA accepted that pathway?
  • What exactly did the 2 September voluntary dismissal in the Astra case dismiss? The filing is not public on RECAP.
  • Was the Aesthetic Envy case served, refiled under a full number, or dropped?
  • Which counts did the AKT Labs operator plead to, and when is sentencing?
  • Is any retatrutide seller on Import Alert 66-41 or the 66-80 red list?
  • What do the two reported deaths show? Only CBS has described them so far.
  • Does WADA's S0 rule cover retatrutide?

How we did this

We searched FDA's full-text warning-letter index for “retatrutid”, “GLP-3”, “GLP3”, “LY3437943” and “triple agonist.” That returned 23 letters; one (AstraZeneca, 2023) did not mention retatrutide, leaving 22. We read each letter in full. Court records come from CourtListener's RECAP archive and docket lists, checked through 13 October 2026.

The limits are real. RECAP holds only documents someone has bought, so some filings are missing. FDA's 2024 designation letter is sealed. We left out FDA's March 2025 letter to state medical boards and a Connecticut attorney general settlement because we could not open the primary pages. We did not transcribe the appeal audio.

FAQ

Frequently asked questions

Is it legal to buy retatrutide in the US?

No retatrutide product is approved, so there is no lawful prescription product to buy. FDA treats retatrutide sold as 'research use only' but marketed for people as an unapproved new drug, and Lilly says it cannot legally be sold for human use. The public actions we found target sellers, clinics, a pharmacy, an API distributor and a physician who resold to patients, not individual end users. That is a description of the record, not legal advice.

Can a doctor prescribe retatrutide or a pharmacy compound it?

There is no approved retatrutide to prescribe. FDA says retatrutide cannot be used in compounding under federal law because it has no USP monograph, is not part of an approved drug and is not on the 503A or 503B bulks lists. Outside clinical trials, the only sanctioned route is Lilly's expanded-access program (NCT07629401), which is limited to people with a BMI of 35 or more, at least two serious complications and no response to approved therapy.

Is retatrutide legal in the UK, Australia or Canada?

It is not approved in any of them. The MHRA has raided three UK production sites since October 2025, the TGA has seized peptides including retatrutide and tested a counterfeit vial, and Health Canada listed retatrutide among unauthorized injectable peptides in April 2026. Each country has its own rules on possession and import, so check the local regulator.

Is retatrutide banned by WADA?

Retatrutide is not named on WADA's 2026 Prohibited List, and the monitoring program covers only semaglutide and tirzepatide. However, section S0 bans any substance with no current approval by a government health authority, including drugs in clinical development. Whether S0 catches retatrutide has not been stated by WADA, so athletes should ask WADA or their national anti-doping agency.

Why is Lilly suing sellers of a drug it does not sell yet?

Lilly argues that unapproved retatrutide sales break state food-and-drug laws, which it pleads as unfair competition, and that clinics advertising it make false claims under the Lanham Act. Defendants answer that Lilly cannot be harmed by sales of a product it does not and cannot lawfully sell. No court has ruled on that standing argument yet.

Will the 7th Circuit appeal decide whether retatrutide is legal?

No. Lilly v. Kennedy asks whether retatrutide is a drug or a biologic, which affects exclusivity, Medicare negotiation timing and compounding rules after approval. It does not change the current position that retatrutide is unapproved. The court heard argument on Sep 24, 2026 and had not ruled as of Oct 14.
